TERMS OF SERVICE
✧Disclaimer
  • The Artist and Client acknowledges that information and materials that are provided to either party outside of the development of Work shall be considered confidential information and shall not be disclosed without prior written permission.
  • Viviria is an officially registered trademark and art name therefore enjoys commercial and legal coverage/copyright.
  • This Terms of Service Agreement is entered into between the Artist and the Client for the commission of an artwork. By commissioning the Artist, the Client agrees to the following terms.
  • Client is 18+ and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf.
⌛Timeline and Process
  • Work completion requires 3 weeks minimum.
  • Timeline depends on commission type, complexity, and workload.
  • If there are any delays and adjustments to timeline, the Artist will inform the Client.
  • I will give you an estimated delivery time, but it can be variable due to workload and personal life, accidents, illnesses etc.
  • I will fix and revise for free as long as the client's requests are feasible and were made in a timely manner.
  • All commissions are digital goods, meaning I will never ship out anything physical to you. The digital goods will be sent to you via a download link.
✦Health Conditions
  • The artist wishes to inform that she lives with a chronic inflammatory condition, which can lead to intense symptoms and episodes of persistent fatigue. Although she is usually able to carry out her work within the expected deadlines, there may be occasional delays during flare-ups. In such cases, she will notify clients as promptly as possible, either through public channels or direct communication.
◆Payment
  • All payments are made via invoices. Do not send money without getting an invoice from me first.
  • I reserve the right to charge more if I deem fit, depending on the complexity of your request.
  • Payment with Paypal, Stripe, Bank transfer or Throne is available.
  • All the prices you see will be converted in euros (€) when I send the invoice.
  • All payments must be made prior to me starting work. Either 50% or 100% upfront unless we agreed upon a payment plan.
  • If we agree on a payment plan, after the first deposit has been done, I will not refund your deposit if you back out of the payment plan.
×Cancellation and Refunds
  • No refunds are possible unless initiated by the Artist.
  • Client warrants they will not issue chargebacks and the refund policy mentioned below will be followed.
  • No refunds or chargebacks to my Paypal possible, also applies to deposit or payment plans.
  • If you request a Paypal chargeback you will lose all the rights to the commissioned piece and I will have the full right to profit further from it in any way.

  • The client is responsible to credit me and link back to my Twitter as their Live2D artist in their Twitter or Twitch bio.
  • You, the Client, may display my work on external sites as long as it is visibly credited and linked back to me.
  • Viviria is an officially registered trademark and art name therefore enjoys commercial and legal coverage/copyright.

  • Commercial pricing goes for 2x - 3x the base commission price depending on project scale.
  • Businesses, agencies, groups and other organizations should contact the Artist to discuss arrangements in more detail.
  • Final prices will be calculated on each client depending on the request and details.
  • Normal commissions don’t require any commercial fee.
  • I consider Twitch & YouTube platforms debut as a future form of profit, so a commercial fee will be applied.
