Violators will be added to my blacklist indefinitely and without warning.

The Artist and Client acknowledges that information and materials that are provided to either party (including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information) outside of the development of Work, that will not be visible to the public, shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.

Viviria is an officially registered trademark and art name therefore enjoys commercial and legal coverage/copyright.

This Terms of Service Agreement ("Agreement") is entered into between the Artist and the Client for the commission of an artwork ("Work"). By commissioning the Artist, the Client agrees to the following terms. The TOS are subject to change without notice.

Client is 18+ and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf.

You are NOT authorized to change, modify or edit my works. (Valid even for the riggers that will receive my Vtuber models, if they will need some edits they have to ask me first and accordingly with the client for major edits or adjustments).

Once it is finished I will send you the requested files via Google Drive link or E-Mail.

You, the Client, are responsible for saving any information, L2D Model file, and other digital data I provide.

Please do not share the file with third parties unless otherwise discussed beforehand.

I will always be able to post wips and previews of your commission; if you wish for your request to be private, it must be stated during the ordering process (for example if you are a Vtuber and want me to keep assets private until your debut).

A fee will be applied for the privacy request, this is because I lose out on my chance to display my current skills for potential customers.

Work completion requires 3 weeks minimum, and may take up to 6 months depending on each project.

Timeline depends on commission type, complexity, and workload.

If there are any delays and adjustments to timeline, the Artist will inform the Client.

I will give you an estimated delivery time, but it can be variable due to workload and personal life, accidents, illnesses etc.

Communication channels may include Discord or Twitter private messages (or others) according to Artist discretion or via Email.

Once Work has begun or payments have been made, the Client acknowledges Work and deliverables are digital and there are no physically shipped goods to receive.

I reserve the right to charge more if I deem fit, depending on the complexity of your request.

Payment with Paypal (invoice) / Stripe or Bank transfer too, even international.

PAYPAL FEES ARE NOT INCLUDED IN MY BASE PRICES.

All the prices will be calculated in euros (€) when I will send the invoice.

If there are plans to use the model for business purposes (this applies to a company or a talent agency commission), the price will be adjusted according to the scale of the project, generally minimum 2x the total price.

If you plan to commission further outfits in the future and want the base of the body clean, you will need to specify this first and pay for it (it will be a base body customized with your character features).

If the client books a slot for a distance of several months (3-6 months), he will have to pay a deposit equal to 30% of the final cost of the commission and pay the rest when we start the commission.

Paying for the invoice means the commissioner acknowledge and accepts these terms and conditions.

Payment plans are accepted only if the amount is substantial or to hold a spot, paying the half.

Client may request for payment plans as long as at least 30% of the payment is done.

The sum of each instalment as well as the time period will be discussed and documented beforehand.

You are expected to continuously pay said instalments without being reminded until everything of the total sum is covered.

The work will be delivered only after the final payment/ second half.

If we agree on a payment plan (of any kind, even half/half), after the first deposit has been done, I will not refund your said deposit if you back out of the Payment Plan, for any reasons at all or if you wanna delete the commission.

The refund is possible only if I delete the commission or I´m not able to do it.

No refunds are possible after work begins unless initiated by the Artist.

Client warrants they will not issue chargebacks and the refund policy mentioned below will be followed.

No refunds or chargeback to my Paypal possible, also applies to deposit (that you will loose) or payment plans.

If you request a Paypal chargeback you will lose all the rights to the commissioned piece and I will have the full right to profit further from it in any way; I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence plus your email confirmation of my TOS (supported by my legal team).

I reserve the right to sign and/or watermark my own work when posted on my Websites and Social Media.

I retain all copyright over my work, which includes the right to use the image as a sample for sales or self-promotion unless otherwise agreed upon.

Intellectual property and credits will still be held by the artist.

Every variation/ edit or change still had to refer to me as the original character designer/ concept artist.

Credit to me, the Artist, is required when you publicly use your Model, or your commission in general.

I will hold every rights of the drawing so you may use it only for private purposes (if not commercial), such as repost it, but you must credit me.

I may use the art you’ve commissioned me on business card, banners, websites, prints or portfolio.

You have to credit me as the creator of the commissioned art, in your bio/Twitch panel credits and when you repost the work on social media, always.

You, the Client, may display my work on external sites as long as it is visibly credited and linked back to me.

The following cases are considered commercial use: Reproducing and selling the artwork, publicly or privately, cases where you receive profit from a medium/platform where you have posted our artwork, (eg. Patreon, YouTube, Twitch, a personal site, etc).

For normal illustrations the price for the Social tier needs to be discussed, the base price increase 30% of the original price.

For Vtuber Models the base commercial fee is already included but the final price will be calculated on the project scale and client itself, as I deem fit.

Note: Businesses, agencies, groups and other organizations should contact the Artist to discuss arrangements in more detail.
