The Artist and Client acknowledges that information and materials that are provided to either party (including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information) outside of the development of Work, that will not be visible to the public, shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.

Viviria is an officially registered trademark and art name therefore enjoys commercial and legal coverage/copyright.

This Terms of Service Agreement ("Agreement") is entered into between the Artist and the Client for the commission of an artwork ("Work"). By commissioning the Artist, the Client agrees to the following terms. The TOS are subject to change without notice.

Client is 18+ and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf.

Work completion requires 3 weeks minimum.

Timeline depends on commission type, complexity, and workload.

If there are any delays and adjustments to timeline, the Artist will inform the Client.

I will give you an estimated delivery time, but it can be variable due to workload and personal life, accidents, illnesses etc.

I will fix and revise for free as long as the client's requests are feasable and were made in a timely manner.

All commissions are digital goods, meaning I will never ship out anything physical to you. The digital goods will be sent to you via a download link.

The artist wishes to inform that she lives with a chronic inflammatory condition, which can lead to intense symptoms and episodes of persistent fatigue. Although she is usually able to carry out her work within the expected deadlines, there may be occasional delays during flare-ups. In such cases, she will make sure to notify clients as promptly as possible, either through public channels (like Discord or Twitter) or, when necessary, through direct communication (DMs, email, etc.).

All payments are made via invoices. Do not send money without getting an invoice from me first.

I reserve the right to charge more if I deem fit, depending on the complexity of your request.

Payment with - Paypal | Stripe | Bank transfer | Throne - available.

All the prices you see will be converted in euros (€) when I will send the invoice.

All payments must be made prior to me starting work. Either 50% or 100% upfront unless we agreed upon a payment plan.

If we agree on a payment plan (of any kind), after the first deposit has been done, I will not refund your said deposit if you back out of the Payment Plan, for any reasons at all.

No refunds are possible unless initiated by the Artist.

Client warrants they will not issue chargebacks and the refund policy mentioned below will be followed.

No refunds or chargeback to my Paypal possible, also applies to deposit (that you will loose) or payment plans.

If you request a Paypal chargeback you will lose all the rights to the commissioned piece and I will have the full right to profit further from it in any way; I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence + your email confirmation of my TOS (supported by my legal team).

I retain all copyright over my work, which includes the right to use the image as a sample for sales or self-promotion unless otherwise agreed upon - Intellectual property and credits will still be held by the artist.

I may use the art you’ve commissioned me (even if commercial) on business card, banners, websites, prints or portfolio.

The client is responsible to credit me and link back to my twitter as their live2d artist in their twitter or twitch bio | Same for publication of arts that always require clear credit back to me.

You, the Client, may display my work on external sites as long as it is visibly credited and linked back to me.

Commercial pricing (reproducing, selling for profit) goes for 2x - 3x the base commission price depending on project scale. (2x if independent, 3x if corporation/ scale of the project-client).

Note: Final prices will be calculated on each client depending on the request and details.

Normal commissions doesn't require any commercial fee.

I consider Twitch & YouTube platforms debut as a future form of profit, so a commercial fee will be applied for anything involved in it. Commercial fees for those platforms refers to TIER 1 below.

I retain the right to post any commission I work on, unless the client wishes to pay an NDA fee.

The NDA fee usually costs +15 - 20% of the original price (depending on the whole amount).
